Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AssessmentPro platform, websites, and related services (the “Service”) provided by Zest Treats Solution(“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AssessmentPro lets you create, publish, and share assessments; collect responses from participants; run live interactive sessions (where participants join by link or QR code); offer optional loyalty points and rewards; and view results and reports. We may update, add, or remove features over time.

2. Accounts

You must provide accurate information when you register and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that happens under your account. Notify us promptly at support@masterclass4u.com if you suspect any unauthorised use. You must be at least 18 years old (or the age of majority where you live) to create an account.

3. Subscriptions, Billing & Refunds

Paid plans are billed in advance on a recurring basis (for example, monthly or annually) until cancelled. By subscribing, you authorise us and our payment provider to charge your payment method for the applicable fees, including any taxes. Fees may change; we will give reasonable notice before a change affects you.

You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and partial periods are not pro-rated. If a payment fails, we may suspend or downgrade your access until the balance is paid.

4. Your Content and Participant Data

“Your Content” means the assessments, questions, and other material you create, together with the responses and information your participants submit. You retain ownership of Your Content. You grant us a limited licence to host, process, and display it solely to operate and provide the Service to you.

You are responsible for Your Content and for how you collect and use participant data, including obtaining any necessary consents and providing your own privacy notice to your participants where required. You must have the right to collect and share any personal data you put into the Service. Our handling of personal data is described in our Privacy Policy.

5. Acceptable Use

You agree not to:

• break the law or infringe anyone’s rights;
• upload malicious code, or attempt to disrupt, probe, or gain unauthorised access to the Service or its systems;
• send spam, harass others, or collect data without a lawful basis;
• resell or provide the Service to third parties except as expressly permitted; or
• copy, reverse-engineer, or create derivative works of the Service.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by Zest Treats Solution and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the Service other than the limited right to use it as described here.

7. Third-Party Services

The Service relies on third-party providers (for example, hosting, database, email delivery, AI text generation, and payment processing). Your use of the Service may also be subject to those providers’ terms. We are not responsible for third-party services we do not control.

8. Assessments Are Not Professional Advice

Assessments, scores, personality profiles, and any AI-generated narratives are provided for informational and developmental purposes only. They are not psychological, medical, legal, financial, employment, or other professional advice, and should not be used as the sole basis for any significant decision about a person.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Zest Treats Solution will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to (for example, to protect the Service or comply with the law). On termination, your right to use the Service ends. We may delete Your Content after a reasonable period, so keep your own copies.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of [your country / state], without regard to its conflict-of-laws rules. The courts located there will have exclusive jurisdiction, except where applicable law requires otherwise.
